What to Know About Warrants and Subpoenas

Judicial Warrants Vs. Immigration Warrants

Judicial warrants are court orders signed by a judge, authorizing law enforcement to enter private property or arrest someone.

ICE/DHS officials, not judges, issue immigration warrants (administrative warrants), and generally do not authorize agents to enter private homes or non-public areas without consent.

Judicial Subpoena vs. Immigration Subpoena

Judicial subpoenas are court orders that judges sign. They require mandatory compliance under penalty of contempt. DHS or immigration judges issue immigration (administrative) subpoenas during investigations. Unlike judicial subpoenas, administrative subpoenas are not immediately enforceable, requiring a federal court order if ignored.
